GENERAL CONDITIONS OF SALE AND USE OF THE WILOUT MOROCCO TICKETING SYSTEM

ARTICLE 1: OBJECT

These General Terms and Conditions of Sale and Use (hereinafter the “CGVU”) govern all use of online ticketing services Wilout Morocco allowing the purchase of entrance fees (hereinafter the “Tickets”) for events organized by third parties (hereinafter the “Organizers”).

ARTICLE 2: ACCEPTANCE OF THE CONDITIONS

The User acknowledges having read these Terms and Conditions and declares to accept them without reservation by ticking the box provided for this purpose when buying a Ticket.

ARTICLE 3: MODIFICATION OF THE TERMS AND CONDITIONS

Active UP reserves the right to modify these Terms and Conditions at any time. The applicable conditions are those in force at the time of validation of the order by the User.

ARTICLE 4: TICKET ORDERING

Orders placed on the site www.wilout.com are firm and final. They result in the issuance of an E-Ticket with a unique QR code sent by email to the Participant. No duplicate Ticket can be issued.

ARTICLE 5: PRICE AND PAYMENT

Ticket prices are indicated in Moroccan Dirhams (MAD) and are expressed All taxes included (TTC).

5.1. Accepted payment methods

- Moroccan and international bank cards via a secure payment system (Morocco Telecom or CMI) .- Cash payment via approved networks (e.g.: Wafacash) .Payment is due at time of order. All transactions are final as soon as the purchase is confirmed.

5.2. Number of tickets

Maximum 15 tickets per person per rate.Prohibition to circumvent the limit by multiple purchases.Tickets do not have numbered placements.

ARTICLE 6: DELIVERY OF TICKETS

Tickets are sent electronically to the email address provided by the User. Tickets can be printed or presented on a smartphone. Only the first person presenting a valid Ticket will be admitted. Any duplication is prohibited.

ARTICLE 7: CANCELLATION AND REFUND

Tickets cannot be exchanged or refunded, except in the case of:- Cancellation of the event by the Organizer.- To postpone the event (in this case, a period of 7 working days is granted to request a refund) .In case of a refund, only the Ticket price is refunded, the transaction fees remain the responsibility of the customer.The Organizer cannot be held responsible in the event of cancellation, delay or modification of the date due to force majeure, including in particular, without limitation: · Natural disasters (floods, earthquakes, fires), · Strikes, earthquakes, fires), · Strikes, · Riots, · Riots, · Acts of terrorism, · Pandemics, · Administrative decisions, · Or any other situation beyond the reasonable control of the Organization Given the evolving global health context, the Organizer reserves the right to implement specific health measures to ensure the safety of participants. The Organizer also reserves the right to modify the program or cancel the event if new health restrictions are imposed by the authorities. Participants undertake to respect all health measures in force. Non-compliance with these may result in a refusal of access without the possibility of reimbursement.

ARTICLE 8: RESPONSIBILITY OF WILOUT MAROC (ACTIVE UP)

Wilout Morocco (Active UP) acts only as an intermediary and cannot be held responsible for incidents related to the organization of the event.

ARTICLE 9: PROTECTION OF PERSONAL DATA

The data collected is intended for Activate UP for the smooth functioning of ticketing services.
In accordance with Moroccan law no. 09-08 relating to the protection of personal data, each user has the right to access, rectify and oppose their data.
To exercise this right, contact support@wilout.ma.Information and data concerning the participant are necessary for the management of the order and the commercial relationship. They are also kept for security purposes and in order to comply with legal and regulatory obligations in terms of data retention. This data will be used in the context of the processing and follow-up of the consumer/participant's order, as well as in the event of the delay or cancellation of the corresponding event.The participant accepts that the Organizer may inform him of any decision affecting the conditions of said event (such as a cancellation, a rescheduling or a change of location), and may use The coordinates he has provided to keep it informed of these changes and the procedures to follow.The processing of this personal data is necessary for the execution of the contract concluded with the participant, as well as for the fulfilment of requests made by the participant before the conclusion of the contract (such as the acceptance of the general conditions of sale), in accordance with article 6, point (b) of the RGPD.The participant's personal data may also be used by the Organizer to send newsletters and to inform by text message or email of future events organized.This processing of personal data meets the legitimate interest of the Organizer as provided for in article 6, point (f) of the RGPD.The participant retains the right to oppose the receipt of these newsletters by clicking on the unsubscribe link at the bottom of the emails and SMS received. He can also express his wish to no longer receive these newsletters by sending an email to the following address: ticketing@mogafestival.com. The participant's personal data collected by the data controller will be kept for a period of Three years.

ARTICLE 10: APPLICABLE LAW AND COMPETENT JURISDICTION

These Terms and Conditions are governed by the Moroccan law. Any dispute will be subject to the exclusive jurisdiction of the courts of Casablanca.

ARTICLE 11: FORCE MAJEURE

No refund will be made in case of cancellation of an event due to Force Majeure (natural disaster, pandemic, etc.).

ARTICLE 12: VALIDITY OF THE CLAUSES

If one or more provisions of these T&Cs are deemed invalid, the other provisions retain their force and scope.

ARTICLE 13: Conditions of use of the Pass

The Pass is strictly valid for The date (s) mentioned on this one. The confirmation email does not constitute a valid Pass. Only the Pass with a QR Code is accepted.Access to the Event is granted upon presentation of a valid Ticket. In the event of loss or inaccessibility of the ticket, the participant must first contact the ticket provider from which he purchased the ticket, the Organiser being contacted only as a last resort. Minors must be accompanied and supervised by an adult and remain under the responsibility of an adult. The Access Pass is nominative; the consumer/participant must present a valid ID at the entrance to the event.Each Access Pass includes a bar code and/or a unique QR code.It is impossible to enter several times on the same day with one and the same Access Pass. The event starts at the time communicated by the Organizer, except in cases of force majeure.It is recommended to arrive at least 30 minutes before the start time.In the event of a delay by the participant, access to the event is no longer guaranteed and no refund will be granted for this reason. All releases are final.

13.2 Ticket control

The tickets will be checked by the Organizer at the entrance to the event using bar code readers. In case of multiple purchases made via the website or a mobile phone, each purchase generates an Access Pass containing a digital barcode displayed on the Pass and verified at the entrance to the event venue.

13.3 Identity and security check


The Organizer reserves the right to verify the identity of the participant at the entrance to the venue of the event.The participant must be in possession of an official and valid photo ID: national identity card, passport, driver's license or residence permit.The participant may be subject to a security search at the entrance and during the event.Access may be refused to anyone refusing this control.For security reasons, the The following items are strictly forbidden inside the event: · Extra suitcases and bags 24 liter (max. 24x45 cm) · Recording devices, cameras, professional photo equipment · Electronic devices, speakers, computers · Selfie sticks · Glass bottles, cans, large bottles (+50 cl) · Corks for bottles under 50 cl · Corks of bottles under 50 cl · Bottles · Gourds· Gourds· Aerosols, poppers, perfume bottles, gas bottles, stoves · Smokes, explosives, liquids flammable materials (e.g. gasoline) · Weapons, sharp or blunt objects, or any dangerous object · Drugs · Alcohol· Drones · Large banners, pointed umbrellas, umbrellas, umbrellas, laser pointers and other potentially dangerous objects· Sound objects (sirens, megaphones...) · Food, drinks and excessive amounts of cigarettes · Motorcycle helmets (This list is not exhaustive and may be adapted according to current regulations or prefectural directives.) 13.4 VIP access


Any participant holding a VIP or backstage ticket will receive a bracelet at the entrance of the event after presenting a valid ticket. This VIP bracelet must be presented at the entrance of the VIP area to access it. The participant is informed that any bracelet cut or detached will be invalid and will result in the denial of access to the VIP or backstage areas.

13.5 CSR conditions


The participant is committed to respecting and reducing their environmental impact when participating in the event. They are also committed to preventing gender-based and sexual violence and to alerting event staff in the event of a risky situation.


13.6 Accessibility and inclusion

The Organizer strives to make the event accessible to all consumers/participants, including people with disabilities. Assistance is available upon prior request. ARTICLE 14: UPDATING THE TERMS AND CONDITIONS

These General Terms and Conditions may be amended at any time by Activate UP to adapt to legislative or technical developments.

ARTICLE 15: RIGHT TO IMAGE

By accepting these terms and conditions, the participant is informed that his image may appear in recordings (including video clips) or broadcasts of the event on any digital, computer or photographic medium. By accepting these conditions, the participant authorizes the Organizer and its service providers (professional photographers, drones, videographers, etc.) to reproduce his image for the purposes of promoting and communicating the Event.This authorization includes the right, for the Organizer and its service providers, to modify, adapt or remove any element of the participant's image considered appropriate, by any process or technique currently known or to be developed in the future.Unless expressly agreed, the Participant's image cannot be used for commercial (for example for the promotion of commercial partners) .The participant only consents to the use of his image by the Organizer in the context of promotion and communication around the event.
